RULES

The "Spot the Whisky Barrel" competition is wholly owned and and operated by Spot the Whisky Barrel Limited, a UK registered private company, (No:SC330025) The registered office address is Port Ellen, Isle of Islay.

The Company has sought legal advice from Biggart Baillie, solicitors in Glasgow, who have reviewed the rules of this competition. The competition has also been reviewed by the Gambling Commission.

The distilleries featured are not involved in the running and promotion of this competition, but they have given their support and their permission to use their logos and to link to their websites.

The barrel drop will comply with any conditions laid down by the Civil Aviation Authority, and by the Maritime and Coastguard Agency.

Please ensure that you have read and understood all of the rules before entering this competition.

The following are the terms and conditions governing this prize competition.
 
1. Entry Validity & Eligibility
  a. All entrants must be aged 18 or over.
  b. Entrants must complete ALL boxes in the entry form for entries to be valid.
  c. If an entrant's personal details should change after their entry has been submitted, it is their responsibility to inform the competition of the changes. Failure to do so may prevent them from receiving their prize.
  d. There is no limit to the number of entries any entrant can make.
  e. Entrants' electronic credit card payment of £25 (Approx 37Euros or $50) must have been successful and the funds be in the competition bank account for entries to be valid.
  f. Entry to this competition implies full and complete acceptance of all the terms and conditions as stated.
  g. The competition organisers reserve the right to amend the terms and conditions at any time.
  h. By submission of one or more entries you are entering a binding contract without possibility of restitution of payment.
  i. Persons connected with the operation administration or promotion are not eligible to enter.
   
2. Entries and Prizes
  a. This competition is limited to 60,000 entries. Once this number of entries is reached the competition will close, and the entry form will be taken off line and replaced with a notification that the competition is fully subscribed.
  b. In the event that the competition does not receive 60,000 entries by the close date of 12th August 2008, the reduced value of entry monies received  will be paid out as CASH PRIZES ONLY, in proportion to the value of the prizes quoted (£660,000) and donations to charity (£100,000). E.g. If 30,000 entries are received ALL PRIZES will be distributed in cash at half their quoted value.
  c. The £25 discount voucher awarded to every entry is redeemable against the cost of one room for one night, at the new Islay Hotel. Multiple vouchers cannot be accumulated and redeemed  against a single night. There is no time limit on this offer.
 
3. Determination of the winner
  a. On the first suitable day  (AFTER the competition closes) we will drop an empty whisky barrel on a parachute from a plane. Exactly five minutes after the barrel lands in the sea a boat will come alongside and its GPS position will be recorded and witnessed by three independent adjudicators.
  b. The entrant(s) with the closest coordinates to the GPS position will be the first prize winner(s)
  c. In the possible event of two or more entries being exactly on, or the same distance from the barrel, the first prize will be divided equally between the winners.
  d. In respect of the second third and fourth prizes, if there are more winning entries than the number required for each prize category, the winners will be electronically selected at random, the persons (s) not winning going into the next prize category.
  e. The winning position, and and the names of all winner(s)  will be announced through this website in conjunction with any publicity at the time.
f. Prize winners will be notified by email, telephone or letter as soon a possible after the drop, but at the latest, within 7 days.
g. The published results will be final - no correspondence will be entered into.
h. All winners agree to have their name used for publicity unless the no publicity box on the entry form is ticked.
i. All prizes will be paid out or despatched as soon as possible after the competition closes, For winners of the third prize, their hogshead will remain in bond at the distillery for their collection.
j. All winners can opt for a cash equivalent prize as shown on the prizes page. Just tick the relevant box on the entry form.
 
4. Adjudication
  a. The barrel drop will be carried out in daylight.
  b. The suitability of the drop day will be dictated by  the pilot in conjunction with Met office weather reports and the coastguard.
  c. There will be an independent pilot on board the plane to adjudicate on the plane's altitude, speed, direction and drop point.
  d. There will be at least three independent adjudicators on the boat that records the GPS position of the barrel.
 
5. Special Prize
a. The name of the new hotel is held in a sealed envelope in safe custody with a bank.
b. If two or more entries select the correct name the special prize will become a cash prize only, and be divided equally between the winners.
c. The winner(s) of the special prize "For correctly guessing the name of the hotel", will be announced at the hotel opening, scheduled for April 2009.
